Terms of Service
1. Who we are
"Nomada", "we", "us", and "our" refer to the operator of the Nomada service, available at trynomada.com. You can reach us at hello@trynomada.com.
2. What Nomada is
Nomada is a reseller of travel inventory (hotels, flights), digital goods (gift cards), and connectivity (eSIMs). We do not own, operate, or control any hotel, airline, retailer, or mobile network. We source inventory from third-party suppliers and process payment on your behalf through non-custodial cryptocurrency payment forwarders.
When you book through Nomada, you are entering into a reservation agreement with the hotel. Nomada acts as an intermediary and reseller. The hotel is responsible for providing the accommodation and services; Nomada is responsible for passing your reservation and payment to the supplier chain.
3. Accounts and anonymous use
You may use Nomada with or without an account. An anonymous booking only requires an email address (for the confirmation voucher) and the guest's name. If you create an account, you're responsible for keeping your credentials safe. You can delete your account at any time by emailing hello@trynomada.com.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use Nomada.
4. Making a booking
When you select a room and proceed to checkout, we create a short-term price lock ("prebook") with our supplier, typically valid for 15 minutes. If payment is not received within that window, the price lock expires and we cannot guarantee the quoted rate.
Once your crypto payment is confirmed on-chain and received by our payment processor, we complete the booking with the supplier. You will receive a confirmation voucher by email, which you must present at check-in.
We make reasonable efforts to ensure that hotel information (prices, photos, descriptions, amenities, availability) is accurate, but all information is provided by third-party suppliers and may contain errors.
5. Payments in cryptocurrency
Nomada accepts payment in a range of cryptocurrencies via our payment processor. By paying in crypto, you acknowledge and accept the following:
- Transactions are irreversible. Once a crypto transaction is confirmed on-chain, it cannot be reversed. Any refund will be processed in fiat equivalent at a rate determined by us at the time of refund.
- Exchange rate risk. The USD-equivalent price shown at checkout is locked at that moment. Crypto market volatility between payment initiation and on-chain confirmation is at your risk.
- You are the legal owner of the funds. You confirm the crypto you're using is lawfully obtained and belongs to you.
- Network fees. Blockchain transaction ("gas") fees are paid by you and are not refundable.
6. Cancellations and refunds
Each room rate has its own cancellation policy, set by the hotel and shown to you before you pay. Policies range from "free cancellation up to 24 hours before check-in" to "non-refundable".
To cancel a refundable booking, email hello@trynomada.com with your Nomada reference number (NOM-XXXXXX) and the email used at booking. We will process the cancellation with the supplier and refund you in the same cryptocurrency (or a stable equivalent), minus:
- Any non-refundable supplier fees charged by the hotel or aggregator;
- Blockchain network fees required to send the refund;
- Exchange-rate differences between payment and refund.
If you need to modify a booking (dates, guests, etc.), contact us as early as possible. Modifications are subject to availability and supplier terms.
7. Your responsibilities
By using Nomada, you agree that you will:
- Provide accurate guest information;
- Comply with the hotel's check-in requirements (ID, age limits, deposit, etc.);
- Not use the service for any unlawful purpose, including money laundering or sanctions evasion;
- Not attempt to disrupt, probe, or reverse-engineer the service.
8. Content and intellectual property
The Nomada name, logo, design, and software are our property. Hotel photos, names, and descriptions are the property of the respective hotels and suppliers. You may not copy, modify, distribute, or exploit any content without permission.
9. Disclaimers
Nomada is provided "as is". We do not warrant that:
- The service will be uninterrupted or error-free;
- Any specific hotel, room, or rate will remain available;
- The hotel will deliver the stay as described;
- The information on the site is complete or free from errors.
We are not responsible for the condition, safety, or legality of hotels, their staff, or their services.
10. Limitation of liability
To the fullest extent permitted by law, Nomada's total liability to you in connection with any single booking is limited to the total amount you paid for that booking. We are not liable for:
- Loss of enjoyment, missed events, or indirect damages;
- Losses caused by factors outside our reasonable control (acts of God, government action, strikes, blockchain network outages, supplier failure);
- Losses arising from inaccurate information you provided (wrong dates, wrong email, etc.).
11. Indemnification
You agree to indemnify Nomada against any loss, claim, or expense arising from your breach of these terms, your misuse of the service, or your violation of applicable law.
12. Third-party services
Nomada integrates with third-party services including LiteAPI (hotel and flight inventory), Bitrefill (gift card and eSIM fulfillment), CryptAPI (non-custodial crypto payment forwarding), Supabase (authentication and database), and Vercel (hosting). Their terms and privacy policies also apply to your interactions with their systems. We are not responsible for third-party service outages or policy changes.
13. Changes to these terms
We may update these terms from time to time. Material changes will be reflected in the "Last updated" date above and, where meaningful, communicated by email to account holders. Continued use of Nomada after changes constitutes acceptance.
14. Termination
We may suspend or terminate access to Nomada at our discretion, including for suspected fraud, sanctions-list matches, or breach of these terms. You may stop using the service at any time.
15. Governing law and disputes
These terms are governed by applicable international consumer protection law and the law of the user's country of residence where mandatory. Where no mandatory local law applies, disputes shall be resolved under the laws of the jurisdiction where Nomada is primarily operated.
Before formal legal action, we ask that you contact us at hello@trynomada.com to try to resolve the dispute informally.
